Risk Assessment under the F&IU Ordinance in Hong Kong
In Hong Kong, workplace safety is a critical concern, and the Factories and Industrial Undertakings Ordinance (Cap. 59) requires employers to conduct thorough risk assessments to identify potential hazards and ensure the safety of their employees. The law mandates that risk assessments be carried out for various workplace risks, such as machinery, chemicals, noise, and confined spaces, to prevent accidents and injuries. Employers must take appropriate measures to control identified risks and ensure that employees are not exposed to harmful conditions. These assessments must be updated regularly, especially when there are changes in the workplace environment or processes.
Legal Requirements and Penalties
The F&IU Ordinance sets clear requirements for employers to perform risk assessments and implement safety measures to protect workers. Employers are required to assess and manage risks, provide training, and ensure the use of personal protective equipment where necessary. Failure to comply with the ordinance can result in significant penalties, including fines of up to HK$200,000 and imprisonment for up to 6 months.
