⚠️ Strict Enforcement by Labour Department: Non-compliance may result in immediate prosecution, hefty fines, or imprisonment.
Under the Factories and Industrial Undertakings (Safety Management) Regulation (Cap. 59AF), designated industrial undertakings must strictly develop, implement, and maintain a Safety Management System (SMS). Do not risk non-compliance. Assess your statutory obligations immediately:
✔️ 14 Statutory Elements: Employers must implement an SMS comprising 14 specified elements, including safety policies, safety organization, safety training, and regular safety audits.
✔️ Mandatory for High-Risk Sectors: Applies to high-risk operations such as construction, manufacturing, chemical handling, and metalworking, or any designated industrial undertakings employing 50 or more workers.
✔️ Criminal Liability & Work Stoppage Risks: Hong Kong OSH legislations have been significantly tightened. The maximum penalty for serious offenses now reaches HK$10 Million and 2 years of imprisonment. The Labour Department conducts continuous surprise inspections. Failure to conduct statutory safety audits can lead to criminal prosecution and Suspension Notices (stop-work orders).
All audits are exclusively performed by Hong Kong Registered Safety Auditors (RSA), ensuring 100% compliance with statutory requirements.
